Terms of Service

These Terms of Use govern your access to and use of We The Loud and all services operated by Be Loud Media at wetheloud.com. By using the platform, you agree to these terms. If you do not agree, do not use the platform.
Who Can Use We The Loud
You must be at least 18 years old to create an account. By registering, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.
We reserve the right to refuse service, close accounts, or limit access at our discretion, particularly where violations of these Terms have occurred.
Your Account
You are responsible for keeping your login credentials secure. Do not share your password. You are responsible for everything that happens under your account.
If you believe your account has been compromised, contact us immediately at support@wetheloud.com.
Community Members
As a member, you can create a profile, post content, join groups, follow other members, and interact with the community. You own the content you post, but by posting it, you grant We The Loud a non-exclusive, royalty-free license to display and distribute it on the platform.
You are responsible for what you post. We The Loud is a venue. We do not editorially approve content before it goes live.
Vendors and Marketplace
Vendors operate independent shops on We The Loud through our marketplace application. By opening a shop, you agree to the following:
- You are responsible for the accuracy of your listings, including descriptions, pricing, and availability.
- You are solely responsible for fulfillment, shipping, and handling returns and refunds directly with your buyers. We The Loud does not manage, mediate, or guarantee vendor transactions.
- You must comply with all applicable laws in your jurisdiction, including consumer protection and taxation requirements.
- We The Loud is not a party to any transaction between a vendor and a buyer. We provide the marketplace infrastructure only.
- Transaction fees apply as disclosed at time of account creation and are subject to change with notice.
We The Loud processes payments through Stripe. Vendors receive payouts according to the schedule defined in their marketplace vendor settings.
Buyers
When you purchase from a vendor on We The Loud, you are entering into a transaction with that vendor directly. We The Loud facilitates payment processing but does not handle shipping, returns, or disputes unless fraud is involved.
If you have an issue with an order, contact the vendor first. If you believe you have been defrauded, contact us at legal@wetheloud.com and we will investigate.
Prohibited Conduct
The following are grounds for immediate account suspension or permanent ban:
- Doxxing: sharing or threatening to share another person’s private information without consent.
- Harassment campaigns targeting a specific user, identity, demographic, minority, sexual orientation, religion.
- Scamming: misrepresenting products, collecting payment without intent to fulfill, or impersonating other vendors.
- Posting or distributing content that sexualizes minors in any form.
- Threatening physical violence against any person.
- Using the platform to coordinate illegal activity.
Strong opinions, unconventional content, dark humor, and heated disagreement are not prohibited. We The Loud is a free-expression community platform, not a brand-safe content garden, however hate speech will not be tolerated.
Intellectual Property
Do not post content you do not have the right to share. If you list products that use licensed images, trademarks, or copyrighted designs without authorization, you are in violation of these Terms and potentially applicable law. We The Loud will remove infringing content and may suspend the associated account.
If you believe your intellectual property has been infringed, contact legal@wetheloud.com with details.
Availability and Changes
We The Loud is provided on an “as is” basis. We do our best to keep things running, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time.
Limitation of Liability
To the maximum extent permitted by law, Be Loud Media is not liable for indirect, incidental, special, or consequential damages arising from your use of the platform, including losses resulting from vendor transactions, content posted by users, or platform downtime.
Our total liability to you for any claim related to We The Loud will not exceed the total fees you paid to us in the 12 months preceding the claim, or $100 CAD, whichever is greater.
Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.
Changes to These Terms
We may update these Terms at any time. We will post the updated version with a new date. Continued use of the platform constitutes acceptance of the revised Terms.
